“Skinny label” cases traditionally considered the inclusion of a patented use within the “indication” section of a generic/biosimilar drug manufacturer’s product monograph. As patentees may not be able to rely heavily on direct infringement of use claims, the focus was on indirect infringement (inducement). Recent inducing infringement decisions seem to consider product monographs more broadly.
